Should I get an attorney and file a lawsuit?

We took my 5 year old son to McDonalds (along with his brother and sister) and after eating they went to play in the McDonalds Playland. As he came out we noticed he had something in his mouth. It was an already used condom.. My husband immediately told him to put it in the trash. A local policeman came and made a report, we all exchanged contact info. (the supervisor, general supervisor, and the restaurant owner) and I transported my son to the hospital to be tested. Should I take this further? And should I force the McDonalds to pay the hospital bill?

Can you prove, 100%, that the condom was in the play area and your son didn%26#039;t find it somewhere else and bring it in with him? How do you know another kid didn%26#039;t give it to him? Another thing, a grown person, specially two, wouldn%26#039;t be able to fit into most parts of the play area, therefore the chances of it being there because it was discarded by two adults is very slim, it most likely had to be brought in by another child, or your child. If you%26#039;ve taught your kids not to put anything in their mouth, why did he put it in his mouth?


Also, signs are posted, saying supervise your children, if you were truly supervising him, you should have seen some sign of what he had found and what he was going to do.




No, you shouldn%26#039;t take any further action on this matter. You won%26#039;t win. What you really need to do (as has been suggested by others in this forum also) is to begin immediately taking responsibility for your children and watch them so that they don%26#039;t hurt themselves. I agree that the county has parenting programs to teach you how to control your children and how to care for them properly. That%26#039;s you main job to do -- and you have been lax. It%26#039;s your fault, not McDonald%26#039;s. For your daughter to be hitting your son on the head causing the skin to break -- that%26#039;s serious and she might need some psychological counseling to control her anger. He could have had a concusion -- and it could have been much worse. Good luck with this. I hope you follow up.




Why don%26#039;t you supervise your kids better and look over their surroundings better before turning them loose. Just hope that the child protective services doesn%26#039;t lake them away from you for being flaky parents. I don%26#039;t believe your numb-skull white trash story. Some attorney will take the case if you what to push it that far.




YES definitly you should have them pay the hospital bill at least. i pray to god that his test come back clean. if not then i fell sooo sorry for you your son and your entire family.

McDonald%26#039;s was only partially responsible for this, but that%26#039;s just plain nasty. I say go for it.
